Terms & Conditions

The terms on which Mobilistan sells phones on a Sharia-compliant Musawamah deferred sale: the fixed price, payments, reminders and device security, and your rights.

Last updated 6 October 202612 min read
  • A sale, not a loan

We own the phone before we sell it to you, at one fixed price that never increases.

  • No late fee, ever

No penalty, interest or charity charge is added because a payment is late.

  • Clear rules on both sides

Exactly when reminders come, when a phone may be restricted, and how it is released.

A summary to help you read. The full text below is what applies.

About these terms

These Terms and Conditions (the “Terms”) govern your use of mobilistan.pk and the Mobilistan apps, and every purchase you make from MOBILISTAN (PRIVATE) LIMITED (“Mobilistan”, “we”, “us”), whether online, through a Mobilistan branch or through one of our partner shops.

When you buy a phone on instalments, you also accept a Musawamah Deferred Sale Agreement for that phone (the “Sale Agreement”). The Sale Agreement records the particulars of your purchase: the phone and its IMEI, the total sale price, the advance, the instalments and their due dates. If anything in these Terms conflicts with your Sale Agreement, the Sale Agreement prevails for that purchase.

Please read these Terms, and in particular section 7 (Reminders and device security), before you accept a Sale Agreement. By applying for or buying a phone, you confirm that you have read and accept them.

  • “Device Security” means the phone maker’s own device-management service described in section 7.

Who can buy on instalments

To apply for a phone on instalments, you must:

  • be at least 18 and not more than 65 years old;
  • hold a valid Computerised National Identity Card (CNIC) issued in your own name;
  • have a mobile number of your own that uses WhatsApp; and
  • give us a guarantor and a reference who know you and agree to be contacted.

We may set further criteria, which we explain to you before you accept a plan.

Applying and approval

5.1Your application

You may apply at mobilistan.pk, in a Mobilistan app, at a Mobilistan branch or at a Partner Shop. We ask for your CNIC (photographs of both sides), a photograph of you taken during the application, your contact details, address, occupation and income, and the details of a guarantor and a reference. How we use this information is explained in our Privacy Policy.

5.2Accurate information

Everything you give us must be true, complete and your own. Giving false information, or using another person’s identity, is a serious breach of these Terms and may also be an offence under Pakistani law. We may decline or cancel an application, or treat a completed sale as obtained by misrepresentation, if we find the information was false.

5.3Credit check

With your consent, we obtain your credit report from a credit bureau licensed by the State Bank of Pakistan, to help us decide your application.

5.4Our decision

Approval is at our discretion. We may decline an application without giving reasons. An approval, or a price shown before your Sale Agreement, is not an offer to sell until the steps in section 6 are complete.

How the sale works (Musawamah)

Every instalment purchase from Mobilistan is a Musawamah deferred sale: a sale of a specific phone at a price agreed between you and us. It is not a loan of money, and no interest is charged.

6.1We own the phone first

After you choose a phone, we buy that specific phone and acquire its ownership and actual or constructive possession. Only then do we offer it to you for sale.

6.2Everything is shown before you accept

Before you accept, we show you the phone and its IMEI, the Total Sale Price, the Advance, the number and amount of the Instalments, and every Due Date, together with these Terms and the device security terms in section 7.

6.3When the sale is made, and ownership

The sale is concluded, and becomes binding on both of us, when you accept the Sale Agreement by digital signature or confirmation. From that moment the Phone is yours. It is handed over to you only after the approved transaction sequence has been completed.

6.4A fixed price

The Total Sale Price is higher than the price for immediate cash payment, because it is a price for deferred payment. It is fixed when the sale is concluded and never increases, whether because of delay, the passage of time or any later change in our prices. The Advance forms part of the Total Sale Price.

Reminders and device security

Please read this section carefully before you accept a Sale Agreement.

7.1Installation

Every phone sold on instalments has Device Security installed and activated before hand-over. It is the phone maker’s own device-management service, provided through our official partnerships with Samsung, OPPO, Infinix, TECNO, itel and Villaon. You agree to its installation and continued operation while any amount remains outstanding under your Sale Agreement. It is a condition of every instalment sale.

7.2Reminders

For each Instalment, we send reminders to you as follows:

  • two days before the Due Date, on the Phone;
  • on the Due Date, on WhatsApp and on the Phone;
  • on the day after the Due Date, on the Phone; and
  • on the second day after the Due Date, at or after 10:00 PKT, a final notice on WhatsApp and on the Phone stating that the Phone will be restricted at 15:00 PKT that day if the Instalment remains unpaid.

Where you use the MPay app, the same reminders may also appear as app notifications.

7.3Restriction

If an Instalment remains unpaid at 15:00 PKT on the second day after its Due Date, we may restrict the use of the Phone through Device Security. Restriction is a payment-management measure only. It does not increase the Total Sale Price and does not create any fee, penalty, charity amount, interest or other monetary charge.

7.4Release

Once the overdue Instalment is paid and the payment is confirmed, the Phone is released automatically, usually within minutes. If more than one Instalment is overdue, the Phone remains restricted until all overdue Instalments are paid. There is no charge for release.

7.5What Device Security is not used for

We do not use Device Security to read your messages, view your photographs, listen to your calls or access your contacts, and we never use it to recover any amount other than the Instalments due under your Sale Agreement.

7.6Removal

When the Total Sale Price has been paid in full, Device Security is permanently removed from the Phone.

7.7No tampering

While any amount remains outstanding, you must not remove, disable, bypass or interfere with Device Security, including by resetting, re-flashing or modifying the Phone’s software.

Paying your instalments

8.1When to pay

You must pay each Instalment on or before its Due Date, as shown in your Sale Agreement and in your Mobilistan account.

8.2How to pay

You may pay through mobilistan.pk/pay, the MPay app, or our payments helpline, or by any other method we announce on our website. Pay only through these channels. We will never ask you to pay into a personal bank or wallet account, and we will never ask for your MPIN, PIN or a verification code.

8.3How payments are applied

Each payment is applied to the oldest unpaid Instalment first. You may pay a later Instalment before its Due Date once the earlier ones are paid.

8.4No late payment charges

No late payment fee, penalty, charity amount, interest or other monetary charge is imposed because a payment is late.

8.5Paying early

You may pay the whole outstanding balance at any time. Because the Total Sale Price is fixed, paying early does not by itself reduce it. Any reduction we may choose to give for early settlement is at our sole discretion, decided at the time, and is not a term of the sale.

8.6Payment records

Our system records every payment against your account. If a payment you made does not appear, do not pay again: contact our payments helpline with your transaction reference and we will trace it.

If instalments remain unpaid

If an Instalment remains unpaid, we will contact you, and where we cannot reach you or the matter is not resolved, your guarantor and reference, to arrange payment. Our staff are required to be courteous. We do not use threats, abuse or public embarrassment to recover payment, and we do not contact your employer or community about your account.

Where Instalments remain unpaid for an extended period despite our contact, we may take any step available to us under your Sale Agreement and Pakistani law to recover the amounts due, including legal proceedings. We will write to you before starting legal proceedings.

If you are facing difficulty, contact us before the Due Date. We will listen and, where we reasonably can, agree a way forward with you.

Your guarantor and reference

You confirm that your guarantor and reference have agreed to their details being given to us and to being contacted about your application and account. A guarantor takes on a personal obligation to pay only if they sign a separate guarantee with us.

Warranty, returns and refunds

Every phone carries the manufacturer’s warranty, which applies on its own terms and is handled by the manufacturer’s authorised service centre. Before you accept, you can review the phone’s identity, specifications and condition.

Cancellations, returns and refunds are governed by our Returns & Refunds policy, which forms part of these Terms.

Your account and messages

12.1Keeping your account safe

You sign in to your Mobilistan account with a code sent to your WhatsApp number. Keep your codes private and tell us straight away if your phone or number is lost or stolen, or if you change your number.

12.2WhatsApp and notifications

By giving us your WhatsApp number you consent to receiving verification codes, application and order updates, payment reminders and account notices from us on WhatsApp. You may withdraw this consent as described in our Privacy Policy; we will then contact you by SMS or telephone, including for the notices in section 7.

12.3Deleting your account

You may ask us to delete your online login at any time by contacting us. Deleting your login does not cancel a Sale Agreement or any amount due under it, and we keep the records of your purchase and payments as required by law.

Sharia compliance

Our Musawamah model, contracts and transaction process are reviewed and certified by Al Hijrah Sharia Advisory Services (certificate AHC/MOB/SCC/2026/006). These Terms are to be read and applied consistently with that approved structure. Details are on our Sharia compliance page.

If you believe any part of a sale was not carried out in accordance with the approved structure, tell us. We will review it with our Sharia advisor and reply to you.

Using our website and apps

You must not attempt to gain unauthorised access to our systems, interfere with their operation, submit another person’s information, copy or scrape their content for commercial use, or use them for any unlawful purpose.

The Mobilistan name, logo, website and app content belong to MOBILISTAN (PRIVATE) LIMITED and may not be used without our written permission. Product names and logos belong to their respective owners. Product images are illustrative, and colour and finish may vary slightly.

We work to keep our services available and accurate, but they may occasionally be interrupted for maintenance or for reasons outside our control.

Our responsibility to you

We are responsible for loss that is a foreseeable result of our breach of these Terms or of our negligence. We are not responsible for loss that was not foreseeable, for business losses, or for loss caused by events outside our reasonable control.

We are not responsible for loss of data or of use of the Phone arising from a restriction that was applied in accordance with section 7. Please keep your own backup of important data.

Nothing in these Terms limits any right you have, or any liability we have, that cannot be limited under Pakistani law, including under the consumer protection law of your province.

Complaints and disputes

If you have a complaint, contact us at support@mobilistan.pk or +92 317 8600078. We will acknowledge it within three working days and aim to resolve it within thirty days.

If we cannot resolve it, you may refer the matter to the competent consumer court or civil court. These Terms and every Sale Agreement are governed by the laws of Pakistan, and, subject to your rights under consumer protection law, the courts at Quetta, Balochistan have jurisdiction.

Electronic acceptance and records

You agree that your digital signature or confirmation of a Sale Agreement, and the system records of your transaction (including the particulars, payment schedule, payments and notices), are valid and binding, and may be relied on as evidence, in the same way as a signed paper document, as recognised by the Electronic Transactions Ordinance, 2002.

General

18.1Whole agreement

These Terms, our Privacy Policy, our Returns & Refunds policy and your Sale Agreement are the whole agreement between us. Nothing said by any member of staff or any Partner Shop adds to, varies or overrides them unless we confirm it in writing.

18.2Partner Shops

Partner Shops are independent businesses. Where a purchase is made through a Partner Shop, the sale of the Phone to you is made by Mobilistan under these Terms and your Sale Agreement.

18.3No waiver

If we delay or do not enforce a right on one occasion, we do not give up that right.

18.4Severability

If any part of these Terms is found invalid or unenforceable, the rest remains in force.

18.5Transfer

We may transfer our rights under these Terms and your Sale Agreement to another person, and will tell you if we do. You may not transfer yours without our written consent.

18.6Events outside our control

We are not responsible for delay or failure caused by events outside our reasonable control, such as network or power failure, natural disaster or civil disturbance.

18.7Language

These Terms may be provided in English and Urdu. If the two differ, the English version prevails.

Changes to these terms

We may update these Terms. The date at the top shows when they last changed. A change never alters the Total Sale Price, the Instalments or the Due Dates of a sale already concluded. The Terms that apply to a purchase are those in force when you accepted its Sale Agreement.
