Please read these Terms and Conditions carefully. By choosing a certain payment plan, the customer agrees to be bound by the terms and conditions set out below. If the customer does not agree to the terms and conditions, the customer must not sign the agreement.

Definitions Capitalized terms used herein but not otherwise defined shall have the meaning given to them in the company’s Terms and Conditions:

The following definitions in this clause shall apply to these Terms and Conditions:

(A) “Application” means (i) The online and offline services offered by Mobilistan Private Limited to the customers, including services such as opening an account, making enquiries about accounts, and account transactions; (ii) requesting the service and viewing eligible transactions; and (iii) any other service as the company may decide to make available from time to time through the internet or outlets. (B) “Company” means Mobilistan Private Limited or any subsidiaries, successors, assignees, or legal advisors. (C) “Confirmation Page” means the page that will be displayed on the company’s website after the eligible customer confirms their willingness to benefit from the service, which will contain particulars such as the possible payment plan(s) or purchases. (D) “Customer” means an individual or company that uses its online or offline services. (E) “Merchant” means any corporate entity, person, establishment, or third party supplying goods and services to the customer. (F) “Payment Plan(s)” means the payment plan(s) made available to the Customer after fulfilling the requirements or criteria as agreed upon in the P.P. form. (G) “Service” means the “Sharia-Complaint Buy Now Pay Later (BNPL)” service offered by the company to the customer, which allows the customer to receive a portion of the eligible transaction items on an installment basis into their account and then repay such loan or installments to the company by the payment plan prescribed in the P.P. form. (h) ‘P.P. Form’’ means the agreement that contains the customer information, payment methods, mobile information, and guarantor information. (I) “Terms and Conditions” means these Buy Now Pay Later Terms and Conditions, as modified by the company from time to time. (J) “website” means: www.Mobilistan.pk.

If the customer has purchased any company products, the customer agreement with the company is made up of these undermentioned terms and conditions:

  • Identification Proof: The customer must provide their original CNIC (Computerized National Identity Card) along with a copy for identification verification during product delivery.
  • Accuracy of Information: The customer declares that all the information provided in the PP Form is accurate and complete to their knowledge. The customer Authorizes the company to obtain and verify their information from credit bureaus, agents, banks, financial institutions, companies, and markets or use a third party for credit verification purposes during the application process and throughout the financing period.
  • Customer’s Representations: If any of the personal details provided by the customer change (including the customer’s or any contact details), then the customer must notify the company immediately, as the company relies on the customer to keep the customer’s contact and other information current. Suppose the customer does not notify the company of changes to personal details. In that case, the company will not be responsible for any issues or claims that may arise due to the customer not notifying the company on time.
  • Authorization and Verification: The customer authorizes the company or its appointed agents to contact and use their provided information for verification purposes during the application process. This includes residence, work, and reference details, as well as any necessary verification for the company’s satisfaction.
  • Payments: The Advance payment and monthly installments must be made through the designated payment methods.
  • Installed software or Accesses and Device Lock: 6.1: The company may, as per the agreement, have access to the camera on or off, SIM card on or off, location trace, and password change of the customer’s device by using the installed software to prevent non-payment of the installments to keep the company safe from loss, etc.  6.2: The company is bound to remove the installed software after the full payment of the installments. 6.3: The customer will be bound to pay a fine of Rs. 1000 PKR if the customer removes or tries to remove the installed app or software from the mobile before full payment of the installments. 6.4: The company is empowered to lock the device, camera, sim, etc. in case of non-payment without any prior notice to the customer.
  • Ownership: The customer acknowledges that the financed device or item remains the property of the Company until full payment is made by the customer. And any claim regarding the ownership will have no legal status or value.
  • Device brick responsibility: if the customer tries to circumvent the installed software or app by rooting the device or sabotage, the customer assumes accountability for any resultant damage to the device. Additionally, if the customer sells or endeavors to sell the device owned by the company before the installment plan reaches maturity or is fully paid off, the outstanding amount will become immediately due to. And the company reserves the right to pursue legal action against the customer. 
  • Device Lock for Late Payments: The financed device or item will be locked via the device lock program or feature and restricted from registering on a cellular network if installment payments are not made on time. The customer has a two-day grace period to clear the payment, after which the device will be locked. Once the installment(s) are paid, the device will be unlocked. The company utilizes Device Lock Technology to lock the device in the event of a customer’s failure to pay installments by the due date mentioned in the payment schedule as per PP Form.
  • Debt collection: 10.1: If the customer fails to make payments on time, the company is empowered to transfer the customer due payment to guarantors, and the debt may be transferred to customer guarantors to make sure the fulfillment of the remaining payment or installments. The company is empowered to receive the unpaid amount from the guarantor as per the agreement prescribed in the P.P. Form. 10.2: in case of the customer’s death the remaining payment will be transferred to his or her successor or guarantors. 10.3: if a customer fails to make an installment on the due date one month, the customer is bound to pay the missing installment next month along with the due installment. 10.3: The company for recovery purposes may reach the customer’s residence, office, home, etc. through its agents or employs without any prior notice. 10.4: if the customer uses filthy language or insults, hit or by force stop the company’s employ or agent, the customer will be held responsible and will be charged guilty for the act and will face legal consequences and damages for the same.
  • Cancellation: The customer is not able to cancel a sale once the customer has paid advance money or agreed to the payment of the purchased items as per the agreement mentioned in the P.P. Form.  
  • Marketing: Company Online services may contact customers at any time for marketing purposes. The company may send or show notifications through installed apps or software.
  • Account’s policy:13.1:To apply for a company’s BNPL service, the customer must (among other things): (a) be a Pakistani citizen or permanent resident; (b) be over 18 years of age; (c) provide the company with any information the company reasonably requests to assess the customer’s account or Data. 13.2: The application for a company account can be made by completing an application online or offline by using the official website of the company product(s) and agreeing to the repayment schedule and financial table about a proposed purchase or may reach outlets. 13.3 If the customer’s application is approved, the customer will be provided with a company account through which the customer can access or purchase product(s). 13.3: Once the customer’s company account is open, all the customer’s current and future BNPL products will operate through the customer’s company account according to the company’s terms and conditions. 
  • Acceptance or rejections of Application: The company reserves the right to approve or deny any application and is in its complete discretion. 14.1: The customer’s company account is not transferrable and can only be used by one customer, and only the company is empowered to do so. 14.2: The company may review the customer’s company account at any time, and the customer must provide the company with any information it reasonably requires to conduct such a review.
  • BNPL Services: once the customer’s BNPL application is approved and the P.P. form is filled, the customer will be provided forthwith with a product for which the agreement was executed.
  • Making Payments: 13.1: Payments will be made by direct debit at regular intervals by the direct debit card information or customers bank check provided by the customer or through company outlets. The customer will be given a receipt or online verification for each payment. 13.2: if the customer makes payments without receiving the receipt or verification from the company, the company holds no responsibility for later claims.
  • Third-party Apps and Device Security: The customer agrees to comply with all applicable guidelines and restrictions, particularly regarding the installation of unsecured third-party apps, including open-source applications or SDKs, as defined by relevant app store policies & regulations. The customer also acknowledges that the device location services remain enabled throughout the financing period.
  • Customer’s Account information or Data: 18.1 The customer can get information relating to the company products online via the company’s official website or from company’s outlets. if the information is not accessible via the company’s official website, it will be provided to the customer via email or SMS periodically; alternatively, the customer can request information about company products by contacting the company through any communication channels on office hours. 18.2: The customer should check the customer’s account information carefully to ensure that the entries are correct and up to date. If the customer is aware of any error in the customer’s account information, the customer must contact the company immediately. 18.3 Customers are responsible for ensuring that the company has the customer’s most recent email address and contact number. Enabling the company to stay in contact with the customer.
  • Default: 19.1: The customer will be in default under the agreement made with the company if the customer fails to make a regular payment on the due date as prescribed in the P.P. Form. (b) breach a provision of the agreement and continue non-payment of the regular monthly payments; (C) give the company incorrect, incomplete, or misleading information. 19.2: Subject to clause 19.1, the company will notify the customer with a default notice by notifying them using communication channels such as call, SMS, email, etc., and the company is empowered to lock the device in case of non-payment of the installments on due dates before it exercises any of its legal rights, and the company may take further action to enforce its rights and recover the installments missing or unpaid by filing a civil as well as criminal suits against the customer in a proper court of law.
  • Privacy Policy: 20.1 The Company complies with the Pakistan Privacy Principles and only collects the personal information that the customer provides in the P.P. Form for the verification and application process. If the company needs any information about a customer, the company may utilize the services of agencies, banks, and other third parties to verify the information that the customer has provided in the P.P. Form. The company will only use the customer’s personal information for the purposes set out in its Privacy Policy to comply with applicable laws. 20.2: The company will only retain the customer’s personal information for as long as it is necessary to satisfy the purpose for which it was provided and as required by law. The company does not generally share the customer’s personal information with others unless this is necessary or required by law. 20.3: The customer may ask to see any personal information that the company holds about the customer at any time, and the company will provide the customer with access. If there are any errors or omissions in the information held by the Company, the customer may ask for it to be corrected.
  • Refund policy: The company did not accept the once sold device. The company have no refund policy and any claim regarding the refund will have no legal value and will not be accepted as per law or order.
  • Sell and change of ownership: If the customer intends to sell or change the ownership of the purchased device before the full payment of the installments. The device will be declared “stolen” and the company reserves the right to take action. In case of failure to notify the company or fraudulently sell the device before its full payment, the company is empowered to lock the device. and the customer will be held responsible for the same.
  • Warranty and service centers: Warranty items and coverage are as mentioned on the warranty card, and all warranty claims must be made at an authorized service center of the Brand. And the Warranty coverage is provided as per the terms and conditions mentioned on the warranty card accompanying the device.
  • No Warranty for Defects: the company holds no responsibility for any defects in the smartphones sold and does not provide any warranty, whether expressed or implied, regarding their condition, suitability, or efficacy, as allowed by law or custom.
  • Complaint and installment obligation: Any complaint about the quality of the items purchased on installments rendered by the supplier does not exempt the customer from the obligation to continue paying the monthly installments to the company.
  • Early payments: The customer can choose to pay off the full financing amount or make an advance payment of the installment at any point in time. 
  • Severability: If any term of the Agreement or terms and conditions is held to be invalid, illegal, or unenforceable for any reason, then the affected terms will be severed from the Agreement, and the remaining terms will remain valid and enforceable.
  • Financing tenure: The financing tenure is determined by the financing payment schedule agreed upon in PP Form.
  • Family affiliation: customer will confirm that, as of today, none of their immediate relatives or family members are employed or associated with the company. The customer is bound to provide details if any family members or relatives become associated with the company.
  • Cases and litigation: If the customer fails to make payment on time and the company has no option to lodge litigation or file a case against the customer, the customer is bound to bear the expenditure of the said cases because the cause was caused by the customer.
  • Device lost, damaged: if the device is stolen, lost, or damaged beyond repair, the customer will still be liable to complete the payment of the said purchase as per the agreement.

The customer accepts the mentioned above Terms and Conditions and agree to be bound by them.
